Terms & Policies

1.1. This tool ("Platform"), owned by Magia Trade, provides its users ("Users" and/or "User") with educational and informational content based on public market data, news, and probabilistic data processed by artificial intelligence technology for market analysis purposes.

1.2. Under no circumstances does the Platform execute trades, carry out brokerage services, or provide investment advisory. It is not registered as a financial institution, brokerage firm, securities distributor, or investment advisor with the Brazilian Securities and Exchange Commission (CVM) or any other regulatory body. The Platform solely provides AI-powered market analysis and insights.

2.1. The content made available by the Platform is strictly educational and informational, providing market analysis and insights with no intention of executing trades or directly managing investments.

2.2. The analysis and insights provided do not replace individual and personalized consultation by qualified professionals, nor do they constitute orders to purchase, sell, or retain any financial assets. Users are responsible for their own trading execution decisions.

3.1. The User acknowledges that all trading and investment decisions, including the execution of any trades, are their sole and exclusive responsibility. The Platform provides analysis only, and Users must execute their own trades through their chosen brokers. Magia Trade, its partners, administrators, employees, and affiliates are released from any liability for losses, damages, or lost profits.

3.2. The User understands and accepts that financial markets involve significant risks and that no analysis or insight, regardless of its source or methodology, guarantees future returns.

3.3. The User agrees to use the analysis tool at their own risk, being aware that using the tool provides market insights only and does not guarantee any economic or financial result.

4.1. Magia Trade is not responsible for any direct, indirect, incidental, consequential, or punitive damages resulting from the use or inability to use the Platform's analysis services, including but not limited to trading losses, business interruption, data loss, or any other damages.

4.2. The Platform's analysis may contain technical errors or inaccuracies, and the information within it may be updated, modified, or discontinued at any time, without prior notice, at the sole discretion of Magia Trade.

5.1. The User acknowledges and agrees to the collection, use, storage, and processing of their personal data by Magia Trade, in accordance with the Brazilian General Data Protection Law (Law No. 13.709/2018 – "LGPD").

5.2. The collected data is intended for: a) User identification and authentication; b) Customization of the analysis experience; c) Compliance with legal and regulatory obligations; d) Continuous improvement of the Platform's analysis capabilities.

5.3. Magia Trade undertakes to adopt appropriate security measures to protect the User's personal data and not to share it with third parties, except with the User's express consent or due to legal obligations.

5.4. The User may exercise their rights under the LGPD, including access, correction, deletion, and portability of data, by submitting a formal request through the official support channel at suporte[at]magiatrade.com.

6.1. Access to the Platform is granted through the creation of a personal and non-transferable account. The User is fully responsible for maintaining the confidentiality of their access credentials.

6.2. The User agrees not to share their account with third parties, under penalty of account suspension or termination, without prejudice to applicable legal measures.

6.3. In the event of unauthorized use, suspected security breach, or loss of access, the User must immediately notify Magia Trade so that appropriate measures can be taken.

7.1. The User may request the cancellation of their account and deletion of their data at any time via the Platform or support channel.

7.2. Account cancellation does not exempt the User from any pending obligations, including financial ones, assumed prior to the cancellation request.

7.3. Magia Trade may, at its sole discretion, suspend or terminate accounts of Users who violate the terms of this agreement, internal policies, legal practices, or Platform usage rules.

8.1. By clicking "I have read and accept" or by using the tool in any way, the User declares that they have read, understood, and fully accept all the terms set forth herein.

8.2. The User also acknowledges that this Agreement may be amended at any time by Magia Trade, and it is the User's sole responsibility to periodically check for updated version(s).

9.1. This Agreement shall be governed by and interpreted in accordance with the laws of the Federative Republic of Brazil.

9.2. To resolve any disputes related to this Agreement, the parties elect the court of the Metropolitan Region of Curitiba, expressly waiving any other, no matter how privileged it may be.
